Terms of Use

Welcome to BdChat. By accessing or using our mobile application and services ("BdChat," "the App," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully before using the App.
1. Acceptance of Terms
By creating an account, accessing, or using BdChat, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the App immediately.
2. Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use BdChat. By using the App, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Account Registration and Security
- You must provide accurate, complete, and current information during the registration process.
- You are solely responsible for maintaining the confidentiality of your account credentials (username, password, etc.).
- You agree to notify us immediately of any unauthorized use of your account or any security breach.
- BdChat will not be liable for any loss or damage arising from unauthorized access to your account due to your failure to safeguard your login credentials or device.
4. Privacy and Data Collection
BdChat is committed to protecting user information and maintaining the privacy of communication within the App. By creating an account and using BdChat services, you agree that your personal and communication data may be collected, processed, and stored as described in these Terms and our Privacy Policy.
4.1 Data We Collect
We may collect the following types of information:
- Account Information: Name, email address, phone number, profile picture, and other registration details.
- Communication Data: Voice calls, video calls, text messages, multimedia files, and metadata related to communications.
- Usage Data: Activity logs, device information, IP address, app interactions, and analytics.
- Location Data: If you grant permission, we may collect location information to provide location-based features.
4.2 Data Security and Encryption
BdChat uses secure, industry-standard encryption protocols (via Agora SDK and other third-party services) to protect data transmission during voice, video, and message communication. While the communication is not end-to-end encrypted, it is secured against unauthorized interception through robust encryption and token-based authentication mechanisms.
Your account credentials, activity logs, and other identifiable information are handled with confidentiality and stored on secured servers with industry-standard protections.
4.3 Data Access and Use
Access to your data is limited to authorized personnel only and is used for the following legitimate purposes:
- Providing, maintaining, and improving BdChat services
- Customer support and troubleshooting
- Compliance with legal obligations, law enforcement requests, or court orders
- Detecting, preventing, and addressing fraud, security issues, or technical problems
4.4 Data Retention
We retain your data for as long as your account is active or as needed to provide services. Even after account deletion, certain data may be retained for legal, regulatory, or legitimate business purposes.
5. User Conduct and Prohibited Activities
You agree to use BdChat in a lawful and respectful manner. You may not:
- Use the App for any illegal, harmful, or fraudulent purpose.
- Transmit content that is defamatory, obscene, harassing, threatening, hateful, or violates the rights of others.
- Impersonate any person or entity or misrepresent your affiliation.
- Distribute spam, malware, viruses, or any harmful code.
- Attempt to gain unauthorized access to other users' accounts or BdChat's systems.
- Reverse engineer, decompile, or disassemble the App.
- Interfere with or disrupt the integrity or performance of the App.
Violation of these rules may result in suspension or termination of your account and legal action if necessary.
6. Intellectual Property
All content, features, functionality, design, logos, and trademarks associated with BdChat are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
7. Third-Party Services
BdChat integrates third-party services, including but not limited to Agora SDK, for communication features. Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
8. Limitation of Liability
To the fullest extent permitted by law:
- BdChat is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted, error-free, or secure operation of the App.
- We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the App, including but not limited to data loss, unauthorized access due to user negligence, service interruptions, or third-party actions.
- Our total liability to you for any claims arising from these Terms or your use of BdChat shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless BdChat, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
10. Modifications to the Terms
We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting within the App or on our website. Your continued use of BdChat after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
11. Termination
We may suspend or terminate your account and access to BdChat at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the App will cease immediately. Sections of these Terms that by their nature should survive termination shall remain in effect.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles.
Any disputes arising out of or related to these Terms or the use of BdChat shall be resolved through:
- Informal Negotiation: We encourage you to contact us first to resolve any issues informally.
- Jurisdiction: If litigation is necessary, you agree to submit to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.
13. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BdChat.
- No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
